LIABILITY AND INDEMNITY – EQUIPMENT RENTAL
This Agreement is made between the Lessor, Silent Mania Events (Pty) Ltd (Reg 2023/505037/07), and the Lessee as stated below.
Rental Items: The Lessor agrees to hire to the Lessee all items listed in the quote, invoice or MOU referenced below.
Payment Terms: The total hire fee and payment terms are as set out in the quote, invoice or MOU.
Responsibilities of the Lessee: The Lessee agrees to obtain consent from all participants, and from parents or guardians of any participants under 18, using the equipment. The Lessee agrees to supervise the use of the equipment and to manage any situation that could cause damage to it.
Liability: The Lessee assumes full responsibility for the rental items for the duration of the rental period and is liable for any loss or damage occurring during that time. A charge of R1,000 per headset and R5,500 per transmitter applies to any item lost or damaged beyond repair. Any other equipment will be charged at replacement cost.
Indemnity: The Lessee indemnifies and holds harmless Silent Mania Events (Pty) Ltd, its staff and affiliates against any claim for injury (including serious injury or death), loss or damage arising from the use of the equipment, except where caused by the gross negligence of Silent Mania Events.
Governing Law: This Agreement is governed by and construed in accordance with the laws of South Africa.
Acceptance: By submitting this form, the Lessee agrees to the terms of this Agreement and to the terms of the referenced quote, invoice or MOU. All equipment will be checked at handover and is accepted in working order unless reported at that time.
